Welcome to Tummy Scanner! These Terms of Service ("Terms") govern your use of the Tummy Scanner mobile application ("App") provided by Lucas Barnes Content ("we," "us," or "our"). By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. App Usage and Purpose

Tummy Scanner is designed to encourage children to finish their meals through a gamified "tummy scan" experience, providing jokes, fun facts, and nutritional information for entertainment and general knowledge purposes only. Parental supervision is required for children using the App. The "tummy scan" feature is a playful simulation and not a medical or diagnostic tool. The content provided should not be considered professional dietary or medical advice.

2. User Accounts

To access certain features, including tracking scan history and subscriptions, you may need to create an account using email/password, Google Sign-In, or Sign in with Apple. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate information during account creation.

3. Subscriptions and Purchases

Free Features:

The App may offer limited functionality for free.

Premium Features:

Access to premium features, such as increased daily scans or additional content, requires an active subscription ("Premium Subscription") or the purchase of scan packs ("Scan Packs").

Billing:

Premium Subscriptions are auto-renewing unless canceled. Payments are processed through the Apple App Store or Google Play Store ("Platform Stores") and are subject to their respective terms and conditions. We utilize RevenueCat to manage subscription status and entitlements across platforms.

Scan Packs:

Scan Packs are one-time purchases granting a specific number of additional scans. Scan Packs have no real-world monetary value and cannot be redeemed for cash or transferred between accounts.

Cancellations & Refunds:

Subscription cancellations and refund requests must be handled through the Platform Stores according to their policies.

4. User Conduct

You agree not to:

• Misuse the App or its content in any way.
• Attempt to interfere with the App's operation or security.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract source code from the App.
• Exploit APIs or other services provided by the App for unauthorized purposes.
• Upload or input inappropriate, offensive, or unlawful content (e.g., in the food input field).
• Use the App for any purpose other than its intended personal, non-commercial use.

5. Intellectual Property

The App and its original content (excluding user-provided food inputs but including generated jokes, facts, nutritional info snippets, design, code, branding, etc.) are the property of Tummy Scanner and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App according to these Terms.

6. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR INDIRECT DAMAGES OR LOSSES ARISING FROM YOUR USE OF THE APP; AND
• YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE APP AND ITS CONTENT.

7. Jurisdiction

These Terms shall be governed by the laws of Ontario, Canada. If you access the App from outside Canada, you agree that any disputes will be subject to Ontario law without regard to conflict-of-law principles.

At Tummy Scanner ("we," "us," or "our"), we are committed to protecting your privacy and handling your data responsibly. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your information.

1. Information We Collect (Data Minimization)

We collect only necessary information required for app functionality:

• Account Information: Name (if provided), email address (including anonymized addresses via Apple Private Relay), User ID (via Firebase Authentication).
• Device Information: Device-level identifiers used for analytics/diagnostics (e.g., Firebase Analytics).
• Usage Data: Interaction patterns like scans performed or features accessed.
• User Input: Food items entered into the app for generating content via APIs (e.g., Google's Gemini API).

We do not collect unnecessary data unrelated to app performance or functionality.

2. How We Obtain Consent

Consent is obtained through opt-ins during account creation (e.g., agreeing to terms) or runtime permissions (e.g., allowing notifications). For children under 13 using the app under parental supervision, consent is obtained from parents/guardians when creating accounts or making purchases.

3. Data Retention Policy

We retain personal data only as long as necessary:

• Account Information: Retained until account deletion is requested by users/parents/guardians.
• Usage Data: Retained in aggregated form indefinitely for analytics purposes.
• Diagnostic Information: Retained until resolved issues are fixed.

Anonymized data may be retained even after account deletion for analytical purposes where it cannot identify users personally.

4. Third-Party Data Sharing

We share data only with trusted service providers who help us operate securely:

• Firebase (Google): Authentication services and analytics tools.
• RevenueCat: Subscription management across platforms.
• Google APIs: Used solely for processing food inputs via Gemini API.

These providers are bound by confidentiality agreements and authorized only for necessary data processing tasks.

5. Children's Privacy (COPPA Compliance)

Tummy Scanner complies with COPPA by ensuring parental consent before collecting personal information from children under 13:

• Parental Consent Verification: Parents create accounts/manage subscriptions via their own platform accounts (Apple/Google).
• Limited Data Collection: Persistent identifiers collected during child sessions are used solely for internal operations like analytics/diagnostics.

Parents can review/delete their child's data at any time by contacting us directly.

6. Data Deletion Requests

Users can request account deletion both within the app settings and via email at tummyscanner@gmail.com. Upon deletion:

• All associated personal data will be removed from our systems within a reasonable timeframe.
• Aggregated/anonymized data may be retained where it does not identify users personally.

7. International Data Transfers

Your information may be processed in countries outside your own where our service providers operate (e.g., Firebase servers). We ensure compliance with applicable laws during such transfers.
